TERO Compliance Officer

JOB TYPE: Full Time

REPORTS TO: TERO Director
SALARY RANGE: $20.15 - $27.23

SUMMARY:
The TERO Compliance Officer is responsible for the enforcement of the TERO law via Band Statutes. The TERO Compliance Officer is responsible for ensuring that Native Americans are employed by Band construction and all other employers on or near the Reservation. The TERO Compliance Officer is required to attend pre-conferences to explain to contractors and employees the TERO law and the TERO compliance plans that must be submitted prior to the start of any construction projects on or near the Reservation.

QUALIFICATIONS:
• Bachelor’s Degree in Business Administration, Human Resources, Construction Management or a related field is preferred with two (2) years related work experience and training. Or an Associate’s Degree in a related field with an additional combination of four (4) years work experience and training in a related field. Or a High School Diploma with six (6) years of education, work experience and training in related fields.
• A minimum of two (2) years of experience in Recruitment, Job Training, Employment Compliance and Monitoring.
• A working knowledge of the construction industry, with at least two (2) years of construction leadership experience preferred.
• Knowledge of federal and Band law regarding Indian Employment Rights and applicable federal labor law is required.
• Must have excellent computer skills with experience and working knowledge in various software programs such as Word, Excel, PowerPoint, Publisher and Outlook.
• Must have excellent organizational, analytical and communication skills, both verbal and written.
• Strong presentation skills and experience in public speaking preferred.
• Availability to work a flexible schedule when needed.
• Ability to investigate thoroughly, to determine facts clearly and to make logical and unbiased conclusions based upon the results of investigation.
• Ability to write clear, accurate reports, and to express ideas effectively in oral and written form.
• Experience should demonstrate effective public relations skills, and an ability to present a professional image for TERO and the Mille Lacs Band.
• Knowledge of the Mille Lacs Band government.
• Understanding of and sensitivity to Native American culture is required.
• Must have a current valid driver’s license.
• Must have reliable transportation.
• Must be insurable under the Mille Lacs Band Drivers Insurance policy.
• Must pass a pre-employment drug and alcohol test.
• Must be able to pass a pre-employment background check.

DUTIES AND RESPONSIBILITIES
• Conduct site inspections and other examinations to ensure compliance with employment and training goals and timetables.
• Maintain a database of qualified, employable Band members and other Native Americans eligible to work on Band construction projects.
• Work cooperatively with other tribal programs, such as Aanjibimaadizing to establish job counseling, training and support programs to assist in employment retention.
• Assist TERO Director in monitoring the labor/workforce market to provide information to develop comprehensive training programs.
• Assist the TERO Director in the initial training plan design and training enhancements.
• The TERO Compliance Officer will schedule, report progress and may even conduct minor training to enhance the skills of Band members and other Native Americans.
• Attend all pre-construction conferences to distribute information to all parties in regard to TERO law and the requirements for the project/worksite.
• Advise and assist Band construction contractors and other employers to develop and implement training programs to develop the skills in the Native American population.
• Source and refer qualified Band members and other Native Americans to Band construction contractors and employers.
• Communicate with Band members on Tribal Employment Rights and employment opportunities (verbally and in written form).
• Establish liaison with Band departments and attend community meetings in each district to represent TERO.
• Conduct preliminary interviews of applicants to determine skill level.
• Advises and counsels individual Band members and other Native Americans in acquiring the skills needed to perform affected jobs and in matters related to the complaint resolutions process.
• Maintains accurate and complete statistical data on compliance investigations.
• Prepares written updated monthly reports to the TERO Director regarding employer and contractor goals along with any compliance issues on all projects.
• Maintains statistical information on TERO applicants employed on Reservation worksites and highway crews on or near the reservation.
• Other duties as assigned.

WORKING CONDITIONS:
• Work is both indoors in a climate-controlled area and periodically outside where exposure to severe weather is possible.
• Little threat of personal danger or risk, although working at construction sites may pose some exposure to danger. Use of safety equipment is required in such circumstances.
• Hours are typically 8-5, but flexibility is required to accommodate worksite compliance checks and attendance at community meetings. Extra hours may be required.
• Local travel to all three districts and the urban area is required. Periodically, other travel within the state may also be required.
